A Gweru man was lucky to escape jail term after he was convicted of indecently assaulting two minors on two separate occasions.
Appearing before Gweru regional magistrate, Beaulity Dube recently, Edson Ushe (43) was found guilty of the offences after a full trial.
Ushe escaped a two year jail term and was ordered to pay a fine of US $400 by May 10.
The State represented by Monica Mungwena outlined that on the evening of December 24 last year, Ushe unlawfully and with indecent intent touched the private parts of the two minors(names withheld), fondled their buttocks and kissed them without their consent.
The court heard that on the said day, Ushe visited the two at their place of residence at around 7pm and stayed for about 30 minutes.
As he was about to leave, Ushe asked for the girls to escort him to his vehicle that was parked outside. On the way to the car, the accused asked for a drink from the girls’ brother.
As the brother went to fetch the drink, Ushe then dragged one the girls by the waist, touched her private parts and fondled her buttocks. He only stopped upon realizing that the brother was returning.
The other complainant was at the main gate and upon reaching the gate, the court heard that Ushe stopped his car and allegedly kissed the complainant once on the forehead and touched her buttocks.
She resisted his overtures, pushed him away and ran back to the house where she narrated her ordeal to the brother.
The brother was brave enough to inform the children’s guardians who later reported the matter to the police.
