A daring Kwekwe couple, who defrauded the wife’s father of his house, will soon know their fate, after they were referred to the High Court for sentencing.
Unity Marengu(37) and her husband, Nelson Farai Marengu(42), recently appeared before a Kwekwe Magistrate facing charges of fraud.
The two are currently in custody awaiting sentencing at the High Court.
Circumstances are that in 2019, Felix Kobeti Magomo, a retired teacher residing in the UK, assigned his daughter, Unity, together with her husband to purchase and develop a residential stand in Kwekwe on his behalf.
Magomo sent a total of US$102,374.00 to his daughter for the project.
The couple acquired stand, number 7082 Hillandale, Kwekwe and an agreement of sale was prepared in their names instead of Magomo’s on December 11, 2019.
The couple developed the property providing updates to Magomo.
Upon completion of the developments in 2021, the accused persons registered the property in their names with the Registrar of Deeds without Magomo’s knowledge or consent.
The matter came to light in November 2021 when Magomo returned to Zimbabwe and requested the agreement of sale.
Marengu’s wife Unity, could not produce the documents to her father.
Instead, she gave him an envelope containing the deed of transfer showing that the property was registered in their names.
The couple avoided Magomo until his return to the United Kingdom.
In April 2022, Magomo returned to Zimbabwe, to resolve the matter and the three had an agreement.
It was agreed that the property would be registered into Felix Kobeti Magomo Trust.
Subsequently, on the 6th of May 2022, Unity and other beneficiaries signed the Trust document.
She, together with her husband, was supposed to donate the property to the Trust.
Broken promise
However, after Magomo returned to the United Kingdom, the couple reneged on their promise to donate the property.
They informed their lawyers that they no longer wanted to donate to the Trust anymore.
The information was relayed to Magomo via email, he returned to Zimbabwe in September 2022, whereupon he made a police report.
The total value of the prejudice to Magomo is US$102,874.00.
